Data protection
With this data protection declaration, we, Dilan Polat Beauty Center GmbH, would like to inform you about how we process and use personal data about you as a user of our web shop (riseandshinecosmetic.eu). The Dilan Polat Beauty Center GmbH adheres to the requirements of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).
- What personal data do we process for what and on what legal basis?
Personal data is all information about a specific or identifiable natural person that you provide to us, that we create or that is otherwise collected by us. In connection with the use of our web shop, we process the following personal data about you:
1.1 Master Data
Master data are name, address, date of birth, telephone, fax and mobile number, email address, as well as your account details and any voluntary information (e.g. credit card details). We process your master data in accordance with Article 6 Paragraph 1 lit. b GDPR in order to carry out the purchase contract concluded with you via our web shop. Without the processing of your master data, it is not possible to conclude or execute a contract. Furthermore, we process your master data to send the e-mail newsletter to which you have subscribed in order to inform you about news and changes within our offer. The legal basis for this is your consent in accordance with Article 6 (1) (a) GDPR. In addition, we process your master data for marketing purposes insofar as we have an overriding legitimate interest in doing so in accordance with Art. 6 Para. 1 lit f GDPR.
1.2 Ordering Data
Order data is the data about the orders you have placed or canceled, such as items ordered, selected payment method and prices. We process this data in accordance with Art. 6 Paragraph 1 lit. b GDPR for the execution and billing of agreed orders. Your order data will also be made available to (other) DP partners, insofar as they are bonus-relevant. In these cases, the legal basis is Article 6 (1) (f) GDPR (legitimate interest). Without this processing of your order data, it is not possible to conclude and execute a contract. In addition, we process your order data for marketing purposes insofar as we have an overriding legitimate interest in doing so in accordance with Article 6 (1) (f) GDPR.
1.3 User Account
To make shopping in our webshop easier for you, you can set up a user account. In this case, we store your master data and your order data (history) under your user account ("My Account"). After you have registered, you can view old orders and place further orders at any time without having to re-enter your data. We process this data in accordance with Article 6 (1) (b) GDPR to provide the user account you require. It is not possible to provide the user account without processing this data.
1.4 Traffic Data
Traffic data is data about your use of the website of our web shop (riseandshinecosmetic.eu), e.g. which pages you accessed when and for how long. Every time a page of our web shop is used, data about this use is stored anonymously in a log file. Personal data is not collected, in particular your IP address and browser properties are not collected. For plug-ins and cookies, see sections 4 and 5. In all cases, the legal basis for the processing of traffic data is our overriding legitimate interest in accordance with Article 6 (1) (f) GDPR.
- Credit checks and automated decision making
In order to be able to offer you the best possible options for choosing the payment method and to rule out difficulties in payment transactions, we protect you and ourselves from misuse by storing orders that require advance payment on our part (payment by cash on delivery, invoice or subscription - currently not offered ), transmit the data required for the credit check (including name, address data, date of birth) to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden. In these cases, the legal basis is Article 6 (1) (f) GDPR (legitimate interest). Payment methods with advance payment are not possible without the credit check.
- links
We use links to other websites and services of third parties, e.g. on social media channels such as Facebook, Twitter or YouTube. These third parties are exclusively responsible for the data processing of such other service providers on their websites and their data protection notices apply.
- Cookies and tracking
4.1 Basic Information
4.1.1 What are cookies?
In order to make our websites as user-friendly as possible and to increase the relevance of our advertising for visitors to our websites, we and our partners use so-called "cookies". Cookies are small files placed on a visitor's hard drive. They allow information to be stored over a certain period of time and to identify the visitor's computer. This is partly done using so-called tracking pixels, which are not stored on a visitor's hard drive, but can help to identify the computer in the same way as a cookie. In the following, the term "cookie" includes cookies in the technical sense as well as tracking pixels and similar technical methods.
If you are visiting our website for the first time, you will see a note on data protection with the consent text in cookies on your start page. If you then continue to use the website and do not object to the use of cookies, this consent will be saved on your browser so that we do not have to show you this notice again on every page. If this notice is missing in your browser (e.g. if you delete the browser history), this notice will be displayed when you visit our website again.
4.1.2 Which cookies do we use?
We use two categories of cookies on our websites: (1) technically necessary cookies, without which the functionality of our websites would be restricted and (2) optional analysis, targeting or advertising cookies:
(a) Technically necessary cookies
These cookies are essential to enable you to move around our websites and use their features. They save, for example, which products you have placed in your shopping cart or the progress of your ordering process, or they enable you to easily search for dealers where you can purchase our products (e.g. by displaying a map of your area). These cookies do not gather any information about you that would be used for marketing or remembering where you have been on the internet. These cookies are session specific and expire after your visit to the website (session). Disabling this category of cookies would limit the functionality of all or parts of the website.
(b) Analytics, Targeting and Advertising Cookies
Analytics cookies collect information about how visitors use a website overall, for example which pages they visit most often and if they get error messages from websites. These cookies do not collect any data that can be used to identify visitors. All information collected using these cookies is only used to understand and improve the functionality and service of the website. We use Google Analytics, a web analysis service provided by Google Inc., to analyze our website. The information generated by the use of Google Analytics about your use of this website is transmitted to a Google server in the USA and stored there. By activating IP anonymization on this website, however, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area.
Targeting and advertising cookies are used to make advertising more relevant to you and your interests. They are also used to limit the number of times you see the same ad, measure the effectiveness of an advertising campaign, and understand people's behavior after viewing an ad. These cookies are usually placed on their sites by advertising networks with the consent of the website operator (ie, in this case, by us). They recognize that a user has visited a website and pass this information on to others, e.g. advertising companies, or adapt their advertising accordingly. Often they are linked to website functionality provided by that company. We therefore use these cookies to provide an association with social networks who may then use information about your visit to tailor advertisements on other websites to you and to provide information about your visit to the advertising networks we use , so that you can be presented with ads that are potentially of real interest to you, based on your browsing behavior.
Disabling this category of cookies does not affect the functionality of our website. We currently use cookies or tracking technology from this category of Google Analytics (Section 4.2).
4.2 Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Inc. 1600 Amphitheater Parkway Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.
If IP anonymization is activated on this website, however, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
You can prevent the storage of cookies by setting your browser software accordingly; we would like to point out to you however that in this case you will if applicable not be able to use all functions of this website in full. You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and from processing this data by Google by downloading the browser plug-in available under the following link and install: http://tools.google.com/dlpage/gaoptout?hl=de .
As an alternative to the browser add-on or within browsers on mobile devices, please click this link to prevent future detection by Google Analytics within this website (the opt-out only works in the browser and only for this domain). An opt-out cookie is stored on your device. If you delete your cookies in this browser, you must click this link again.
- Right to object
You can object to data processing for marketing purposes at any time. This applies in particular to the use of your data to send the marketing newsletter. We are then legally obliged to stop collecting, processing and using data.
If we process your personal data on the basis of a legitimate interest in accordance with Article 6 Paragraph 1 Letter f GDPR, you can object to this processing at any time for reasons that arise from your particular situation. In this case, please contact the office specified under point 9. We will then check whether our legitimate interest in data processing prevails in your case or whether your interests prevail due to your particular situation. In the latter case, we will stop processing your data in accordance with your objection. In this case, we will not be able to process existing and possibly future orders.
- Transfer to third parties
6.1 Disclosure of Data to Processors
In some cases, we use service providers in compliance with the legal requirements by way of order processing, ie on our behalf, according to our instructions and under our control.
Processors are, in particular, technical service providers that we use to provide the website and the practical provision of our services, e.g. service providers for software maintenance, data center operation and technically necessary cookies. For the practical implementation of advertising and marketing, we also use contract processors, e.g. service providers for email dispatch and analysis cookies.
In these cases we remain responsible for the data processing; the transfer and processing of personal data to or by our processors is based on the legal basis that allows us to process the data in each case. A separate legal basis is not required.
6.2 Transfer of Data to Third Parties
Except as explained above, we do not share your personal information with other third parties for marketing purposes.
Personal data will only be transmitted to third parties if and to the extent that (i) this is necessary to process the contractual relationship (in particular transmission to partners for whom your order is bonus-relevant), (ii) we are legally obliged to do so or (iii) it to enforce the contractual relationship or other agreements concluded with you as well as our rights and claims.
If, exceptionally, a partner for whom your order is bonus-relevant is based in a third country outside the European Economic Area, the data will only be transmitted if the requirements for this are met according to the GDPR, in particular if an appropriate level of data protection is ensured at the recipient.
- security
We take appropriate technical and organizational measures, in particular to ensure that your personal data is protected against loss, incorrect changes or unauthorized access by third parties. The measures are constantly adapted to the improved technical possibilities.
